The Legal Foundation of Australian eSignatures
Australia recognised the legal validity of electronic signatures in the Electronic Transactions Act 1999 (Cth). Under section 10 of the Act, a signature requirement is met electronically if three conditions are satisfied: (1) the method used identifies the person and indicates their intent to sign, (2) the method is reliable in the circumstances, and (3) the other party consents to the electronic method.
Every Australian state and territory has passed mirror legislation: Electronic Transactions Act 2000 (NSW), the Electronic Transactions (Victoria) Act 2000, the Electronic Transactions (Queensland) Act 2001, the Electronic Transactions Act 2011 (WA), plus SA, Tas, ACT, and NT equivalents.
